1. SELLER'S IDENTITY

These General Terms and Conditions of Sale (hereinafter "GTC") are concluded between the company SURL Il Nido, with a capital of 10,000 euros, whose registered office is in the Principality of Monaco, at 3bis Bd de Belgique, 98000 Monaco, registered with the Monaco Trade and Companies Register under number (-),
(hereinafter referred to as "Il Nido") and, on the other hand, by any individual (hereinafter referred to as the "Buyer" or "Buyers") wishing to make a purchase via the Il Nido dei Venti website accessible at https://www.nidodeiventi.com/ (hereinafter referred to as the "Site").

2. PURPOSE

These General Terms and Conditions of Sale aim to define the conditions under which the Seller (Nido dei Venti) offers its products for sale (in particular agricultural, processed, or artisanal products) and the rights and obligations of the parties within the framework of online sales.

Any order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

The Seller reserves the right to modify the General Terms and Conditions of Sale at any time. The applicable conditions are those in force on the date of the order.

3. PRODUCTS

The products offered are those presented on the website, within the limits of available stock.

Each product is described as accurately as possible. However, slight variations may exist, particularly due to the natural and artisanal nature of the products.

Photographs are non-contractual.

4. PRICES

Prices are indicated in euros, all taxes included (TTC).

The Seller reserves the right to modify its prices at any time, it being understood that the price applied will be that displayed at the time of the order.

Delivery costs are not included and are specified before order validation.

5. ORDER

To place an order, the Buyer must: select the products, fill in their information (billing and delivery), validate the cart, proceed to payment
Validation of the order constitutes acceptance of the GTC and proof of the contract.

6. AVAILABILITY

Products are offered subject to stock availability.

In the event of unavailability after an order has been placed, the Buyer will be informed as soon as possible and may:


  • receive a refund

  • or accept a replacement product

7. DELIVERY

Products are delivered to the address indicated during the order.

Delivery times are indicative. In the event of a significant delay (exceeding 30 days), the Buyer may request cancellation and a refund.

The Seller cannot be held responsible in the event of:


  • an error in the address provided

  • the absence of the recipient

  • or failure to collect the package

8. RIGHT OF WITHDRAWAL

In accordance with current legislation, the Buyer has a period of 14 days from receipt to exercise their right of withdrawal.

Products must be returned:


  • in their original condition

  • unopened

  • and complete

Return shipping costs are the responsibility of the Buyer.

Refunds will be issued within a maximum of 14 days after receipt of the return or proof of shipment.

9. PAYMENT

Payment is made online via a secure platform.

Bank details are encrypted and never stored by the Seller.

10. LIABILITY

The Seller cannot be held responsible for:


  • damages related to improper use of products

  • site interruptions

  • cases of force majeure

11. CUSTOMER ACCOUNT

The Buyer may create an account to facilitate orders.

The Buyer is responsible for the confidentiality of their login details. Any fraudulent use must be reported immediately.

12. PERSONAL DATA

The information collected is necessary for processing orders.

It is processed in accordance with current regulations (GDPR).

The Buyer has the right to access, rectify and delete their data.

13. INTELLECTUAL PROPERTY

All elements of the site (texts, visuals, identity) remain the exclusive property of the Seller.

Any reproduction is prohibited without authorization.

14. GOVERNING LAW

These General Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal action is taken.
